The Knox and Kane railroad, that formerly took tourists across the Kinzua Viaduct is now filing suit against the Department of Conservation and Natural Resources.
The train company has filed the suit to recover lease payments that were left un-refunded after the bridge’s condition became unsuitable for the train to cross.
The bridge’s deterioration caused officials to close the bridge to traffic June 19, 2002. Knox and Kane Railroad says DCNR continued charging lease payments.
The railroad is seeking 78 thousand dollars in damages resulting from the DCNR actions surrounding the bridge’s demise.
